Terms & Conditions

Please ensure you read the jane michelle : everyday parenting Terms and Conditions carefully.

The terms and conditions constitute a binding contract.

 

1. Parties in Agreement:

Payment for a Package is deemed as acceptance of the jane michelle : everyday parenting terms and conditions.

This agreement is between jane michelle : everyday parenting, and you, the Client.

2. Definitions:

The term ‘Parent’ ‘Client’ or ‘you’ refers to any company or any parent, carer, guardian or authorised adult of the Child/ren in discussion when purchasing any Services.

The term 'Child', ‘Your Child’, 'Their Child', 'Child/ren' refers to the Child/ren in which we are discussing, who is/are in the care of you, the Client.

The term ‘Jane’, 'jane michelle : everyday parenting', 'we', 'she' and ‘her’ refers to Jane Michelle Oehm and the company, jane michelle : everyday parenting.

The term 'Package' refers to the service/s purchased by the Client from jane michelle : everyday parenting.

The term 'Client Information' refers to any information concerning the Client and/or your Child/ren which has been disclosed in the course of Jane delivering the Package of Services under this Contract.

3. Payment:

Payment will be made upon selection of services and is non-refundable.

Payment for an extension of support, beyond that included in the original Package purchase, shall be charged at £100p/w (email & WhatsApp support every second day for one week) or £150p/w (email & WhatsApp support every day for one week). These extensions are non-refundable and support falls within the stated hours of operation.

Troubleshooting calls or detailed emails that fall outside of Packages will be charged at £30 per 30mins.

Troubleshooting calls require payment of call + 20mins, so as to cover call summary email.

All payments can only be made via bank transfer.

4. Cancellation and Rescheduling:

Things come up, don't worry about it, but if you need to reschedule an organised call, Jane requires a minimum of 24hours notice. If you need to reschedule an organised home-visit, Jane requires a minimum of 48hours notice. She will work with you to reschedule for a more suitable time, however, failure to give notice in the specified timeframes may result in a forfeit of this Service .

If you are running late for a call, please message Jane as soon as possible and she will do what she can (depending on her schedule for the day) to provide flexibility - but ultimately - dialing in late for any prearranged calls may result in you losing that amount of time together.

There are no refunds for cancelations of any Package purchased by you, the Client

5. Confidentiality:

All conversations are, and all Client Information is, confidential. Jane will not disclose any Client Information save as maybe required by law, a court of competent jurisdiction or any governmental or regulatory authority. Jane may occasionally anonymously discuss your case with a fellow parenting consultant if she believes their knowledge and insight could be beneficial for your progress.

6. Materials/Content:

Materials and content provided to the Client are owned by jane michelle: everyday parenting and are provided for the Client’s individual use only, and may not be distributed, shared or copied.

7. Hours of Operation:

jane michelle: everyday parenting operates between 9am – 6pm GMT, Monday, Wednesday & Friday.

Organised visits and calls may fall outside of these operating hours when working together and when both parties have agreed to it.

jane michelle : everyday parenting does not operate on U.K bank holidays, so response time may be delayed during these hours.

Jane will do her best to respond to emails and messages promptly, however, if she is with a client then response time may be delayed.

8. Responsibility:

The Client, agrees to working together in partnership with Jane, acknowledging that the success of working with a coach/educator relies on the Parent/s continuing to carry out advice with consistency once the consultation Package is complete.

The Client agrees to express any medical concerns regarding their Child/ren to Jane, and to truthfully answer, to the best of their knowledge, any questions asked by Jane -verbally or in written form.

9. Disclaimer:

• If there is an emergency, medical or other, it is important you respond to your Child/ren immediately.

• If your Child/ren is ill or experiencing discomfort due to development or health issues, in anyway, it may not be appropriate to continue following advice given during these periods.

• The advice given has been constructed based on the information provided to me by you, the Client, and your own specific situation. If your Child/ren’s situation changes, health wise or other, the advice given may no longer be appropriate.

• jane michelle : everyday parenting advises that parents follow the Safe Sleeping and SIDS guidelines when approaching sleep for their Child/ren. Please refer to:

• If I learn of something that suggests a Child is unsafe or in danger, I must report it.

• You acknowledge that all situations and Children differ, thus, there is a period of educated trial and error when you and I work together - and advice given does not, and cannot, ever guarantee a particular outcome with any particular Child.

• You acknowledge the guidance provided is based around my knowledge and experience helping families, however, due to your own understanding of your Child, your own judgement around advice and plans is required, and use is entirely at your own risk, for which I shall not be liable.

• You are under no obligation to carry out advice and plans given.

• Jane of jane michelle : everyday parenting is a sleep and parenting coach/ educator. A sleep and parenting coach/ educator is not a nutritionist, feeding specialist, behaviour therapist, play therapist, speech therapist or child psychologist and should not be used as a substitute for medical advice, including from, but not limited to, your general practitioner, health visitor, paediatrician or neonatal nurse.

10.  Limitation of Liability:

10.1 This clause sets out jane michelle : everyday parenting's liability to you in respect of these terms and conditions (including any breach of these terms and conditions and any statement we make to you about it).

10.2 jane michelle : everyday parenting shall not be liable for:

  • any direct or indirect losses, including loss of profits or consequential losses, liabilities, expenses, claims or damage; and

  • jane michelle : everyday parenting's total liability (In contract, tort Including negligence or breach of statutory duty, or otherwise) shall be limited to the cumulative amount you paid for your Package/s during the course of the contract.

11.  Governing law:

In the case of any dispute or claim arising out of or in connection with these terms and conditions or their subject matter or formation, English law will apply.

12.  Jurisdiction:

Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms and conditions or their subject matter.

13.  Revision to terms and conditions:

jane michelle : everyday parenting reserves the right to review and revise these Terms and Conditions without prior notice.
